The Secretary of State for Wales, in exercise of the powers conferred upon him by section 170 of the New Roads and Street Works Act 1991[1], makes the following Order: Citation, interpretation and application 1. - (1) This Order may be cited as the New Roads and Street Works Act 1991 (Commencement No. 1) (Wales) Order 2004. (2) This Order applies to Wales only. Provision coming into force on 23rd July 2004 2. With the exception of subsection (1)(c), section 79 of the New Roads and Street Works Act 1991 (records of location of apparatus) comes into force on 23rd July 2004. Peter Hain Secretary of State for Wales 7th July 2004 (This note is not part of the Order) This Order brings into force in Wales on 23rd July 2004 the provisions of section 79 of the New Roads and Street Works Act 1991, except subsection (1)(c). Section 79 of the Act imposes a duty on undertakers to keep records of the location of apparatus in streets in certain circumstances. Subsection (1)(c) imposes the duty when the undertaker is informed of the apparatus' location under section 80 of the Act, which is not yet in force. (This note is not part of the Order) The following provisions of Part III of the New Roads and Street Works Act 1991 have been brought into force in England and Wales by commencement orders made before the date of this Order.
