The Secretary of State for Health, in exercise of the powers conferred on him by sections 64(6) and 70(10) of the Health and Social Care Act 2001[1], hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Health and Social Care Act 2001 (Isles of Scilly) Order 2004 and shall come into force on 21st June 2004. Application of the Health and Social Care Act 2001 to the Isles of Scilly 2. Sections 7 (functions of overview and scrutiny committees) and 8 (joint overview and scrutiny committees etc) of the Health and Social Care Act 2001 shall apply to the Isles of Scilly with the modifications that -
(b) the reference in section 8(1) to a local authority operating executive arrangements under Part 2 of the Local Government Act 2000 (in this article referred to as "the 2000 Act")[2] includes a reference to the Council of the Isles of Scilly; (c) references to an overview and scrutiny committee in sections 7(3) and (4) and 8 include references to a committee of the Council of the Isles of Scilly established under section 21 of the 2000 Act for the purpose of exercising the functions under section 21(2)(f) of that Act[3]; and (d) references in section 8(1) to functions which are or would be exercisable by an overview and scrutiny committee under section 21(2)(f) of the 2000 Act include references to corresponding functions exercisable by a committee of the Council of the Isles of Scilly established under section 21 of the 2000 Act for the purpose of exercising the functions under section 21(2)(f) of that Act.
(This note is not part of the Order) This Order extends to the Isles of Scilly as from 21st June 2004, with appropriate modifications, those provisions of the Health and Social Care Act 2001 which are concerned with local authority scrutiny of health service provision.
