The First Secretary of State, on the application of the Council of the Isles of Scilly and in exercise of the powers conferred by section 265(2) and (3) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Isles of Scilly (Functions) (Review and Scrutiny of Health Services) Order 2004 and shall come into force on 21st June 2004. Additional functions of the Council 2. The Council of the Isles of Scilly shall exercise and perform in the Isles of Scilly the following functions, conferred or imposed on local authorities, as if the Council were a local authority operating executive arrangements within the meaning of Part 2 of that Act[2]:
(b) section 21(2)(f) of that Act[3]; (c) section 21(6) of that Act; (d) section 21(7) of that Act; and (e) section 21(10) of that Act.
(This note is not part of the Order) Section 265 of the Local Government Act 1972 enables orders to be made providing for the exercise and performance in the Isles of Scilly of functions which are for the time being conferred or imposed on local authorities. This Order provides for the performance by the Council of the Isles of Scilly of some of the functions conferred or imposed by section 21 of the Local Government Act 2000 on local authorities operating executive arrangements. The application of section 21(2)(f) will require the Council of the Isles of Scilly to establish an overview and scrutiny committee or committees for the purpose of the review and scrutiny of matters relating to the health service in accordance with regulations made under section 7 of the Health and Social Care Act 2001.
