The Secretary of State for Transport, being a Minister designated [1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to measures relating to cableway installations designed to carry people and components of such installations, in exercise of the powers conferred upon him by that section, hereby makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the Cableway Installations (Amendment) Regulations 2004 and shall come into force on 3rd May 2004. Amendment of the Cableway Installations Regulations 2004 2. The Cableway Installations Regulations 2004[3] shall be amended as follows-
(b) In regulation 19(3) for the words "that body" there shall be substituted "him"; (c) For regulation 25(1) there shall be substituted the following:
(b) subsystem with a declaration of conformity,
that has been placed on the market and put into service in accordance with its intended purpose, is not safe, the Executive may serve a notice on the operator to prohibit the use of or restrict the conditions of use of that safety component or subsystem.".
(This note is not part of the Regulations) These Regulations amend the Cableway Installations Regulations 2004 by correcting defects in those Regulations and are being issued free of charge to all known recipients of those Regulations.
