The Lord Chancellor and the Secretary of State, in exercise of the powers conferred on them by sections 13(1) and 13(5)(a) of the Tribunals and Inquiries Act 1992[1] hereby make the following Order: - 1. This Order may be cited as the Tribunals and Inquiries (Dairy Produce Quota Tribunal) Order 2004 and shall come into force on 31st March 2004. 2. In Part 1 of Schedule 1 to the Tribunals and Inquiries Act 1992, for paragraph 13 substitute -
(This note is not part of the Order) The Dairy Produce Quotas (General Provisions) Regulations 2002 provide in particular for the reconstitution of and set out the procedure of, the Dairy Produce Quota Tribunals (regulation 7 and the Schedule). This Order brings the Dairy Produce Quota Tribunal for England and Wales, under the supervision of the Council on Tribunals. Notes: [1] 1992 c. 53. The functions of the Lord Advocate under section 13(1) and 13(5) were transferred to the Secretary of State by article 2(1) of, and the Schedule to, the Transfer of Functions (Lord Advocate and Secretary of State) Order 1999 (S.I. 1999/678) and in so far as they are exercisable in or as regards Scotland, to the Scottish Ministers, by the Scotland Act 1998 (Transfer of Functions to Scottish Ministers etc.) Order 1999, S.I. 1999/1750, article 2, Schedule 1. Section 13(5) was amended by article 337 of the Financial Services and Markets Act 2000 (Consequential Amendments and Repeals) Order 2001 (S.I. 2001/3649) and section 151 of and Schedule 5, paragraph 16(4) to the Pensions Act 1995 (c. 26) and section 177 of and Schedule 7, Part III to the same Act.back
