Whereas Bedfordshire County Council has applied to the Secretary of State for an order to be made under paragraphs 1(1) and 2(1) of Schedule 3 to the Road Traffic Act 1991[1] with respect to part of their area and the Secretary of State has consulted the Chief Constable of the Bedfordshire Police in accordance with the requirements of paragraphs 1(3) and 2(3) of that Schedule; The Secretary of State, in exercise of the powers conferred upon him by paragraphs 1(1), 2(1) and 3(3) of Schedule 3 to the Road Traffic Act 1991 hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Bedfordshire) (Districts of Mid-Bedfordshire and South Bedfordshire) (Amendment) Order 2004 and shall come into force on 5th April 2004. Amendment of principal Order 2. - (1) The Road Traffic (Permitted Parking Area and Special Parking Area) (County of Bedfordshire) (Districts of Mid-Bedfordshire and South Bedfordshire) Order 2004[2] is amended as follows. (2) For article 3(2)(c), substitute -
(ii) from its junction with French's Avenue, Dunstable, to its junction with the road to Tebworth, south of Hockliffe; (iii) from the former junction with Church Lane, north of Hockliffe, to the north western boundary of the district."
(3) In paragraph 7(2) of Schedule 1, for the definition of "parking authority" substitute -
(ii) a vehicle that is or was stationary in such a parking place,
means the authority (Bedfordshire County Council, Mid-Bedfordshire District Council or South Bedfordshire District Council) by whom the parking place was provided, authorised or designated, and
(This note is not part of the Order) This Order amends the Road Traffic (Permitted Parking Area and Special Parking Area) (County of Bedfordshire) (Districts of Mid-Bedfordshire and South Bedfordshire) Order 2004 (the "Principal Order"). Article 3(2)(c) of the Principal Order is amended so that certain parts of the A5 in the district of South Bedfordshire are included in the permitted parking area and special parking area. The definition of "parking authority" inserted into section 82(1) of the Road Traffic Act 1991 for the purposes of the Principal Order is replaced. The authority that provides, authorises or designates a parking place under section 32(1) (power of local authorities to provide parking places) and section 45(1) (designation of paying parking places on highways) of the Road Traffic Regulation Act 1984 is the parking authority in respect of that parking place, or any vehicle left stationary in that parking place. For any other place to which the Principal Order applies, or vehicle left stationary in that place (including the A5 trunk road), the Bedfordshire County Council is the parking authority.
