The Secretary of State, in exercise of the powers conferred upon the Lord Chancellor by sections 58(3)(c), 58A(3) and 119 of the Courts and Legal Services Act 1990[1] and now vested in him[2], makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the Conditional Fee Agreements (Miscellaneous Amendments) (No. 2) Regulations 2003 and shall come into force on 2nd February 2004. Amendments to the Conditional Fee Agreements Regulations 2000 2. - (1) Regulation 3A of the Conditional Fee Agreements Regulations 2000[3] is amended in accordance with this regulation. (2) In paragraph (1), for "paragraph (5)" substitute "paragraphs (5) and (5A)". (3) In paragraph (5) -
(b) at the end of sub-paragraph (d) insert -
(f) is a company for which a receiver, administrative receiver or liquidator is appointed".
(4) After paragraph (5), insert -
(5) In paragraph (6), after the word "client" the second time it appears, insert "or his estate".
(b) in paragraph (6) -
(ii) at the end of sub-paragraph (d) insert -
(f) is a company for which a receiver, administrative receiver or liquidator is appointed";
(c) after paragraph (6), insert -
(This note is not part of the Regulations) These Regulations amend the Conditional Fee Agreements Regulations 2000 and the Collective Conditional Fee Agreements Regulations 2000 by adding to the list of circumstances in which the client may be liable to pay his legal representative's fees and expenses:
(b) his going bankrupt or going into liquidation.
