Her Majesty, in pursuance of section 150(4) of the Broadcasting Act 1996[1], and section 204(6) of the Broadcasting Act 1990[2], as it is applied by section 150(3) of the Broadcasting Act 1996, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows: Citation and commencement 1. This Order may be cited as the Broadcasting (Jersey) Order 2003 and shall come into force on 29th December 2003 and shall be deemed to have come into force immediately after the Wireless Telegraphy (Jersey) Order 2003[3]. Extension of the Broadcasting Act 1996 2. The following provisions of the Broadcasting Act 1996 shall extend, with the modifications specified in Schedule 1 to this Order, to the Bailiwick of Jersey -
(b) in Part II (digital terrestrial sound broadcasting), sections 40 to 72; (c) in Part III (amendments of Broadcasting Act 1990), sections 73 to 76, 78, 79, 82 to 89, 92, 93, and 96; (d) Part IV (sporting and other events of national interest); (e) in Part V (Broadcasting Standards Commission), sections 106 to 126 and 128 to 130; (f) in Part VIII (miscellaneous and general), sections 142 to 148; and (g) Schedules 1 to 4, 8 and 10 and Part I of Schedule 11.
Amendment of the Broadcasting Act 1990 (Jersey) (No. 2) Order 1991
(b) paragraph 1 of the Schedule.
1. Any reference to a provision of the Broadcasting Act 1990 ("the 1990 Act") shall be construed as a reference to that provision as it has effect in the Bailiwick of Jersey. 2. The following provisions, that is -
shall have effect as if any order made under, respectively -
and which is for the time being in force in the United Kingdom, had extended to the Bailiwick of Jersey.
(b) in subsection (7) -
(ii) in the definition of "for general reception", there shall be added at the end the words "and the Bailiwick of Jersey.".

In section 2 -
(b) subsection (4) shall be omitted.
5.
In section 3(8), for the words "section 7 of the Telecommunications Act 1984" there shall be substituted "Part 2 of the Telecommunications (Jersey) Law 2002".
(b) subsections (8) and (9) shall be omitted.
13.
In section 24, subsection (4) shall be omitted.
(b) in subsection (6), the words from "Without prejudice" to "cases),"
shall be omitted.
(ii) in sub-paragraph (ii), the words ", S4C Digital" shall be omitted;
(b) in subsection (3) -
(ii) for paragraph (d) there shall be substituted -

In section 38 -
(c) if the licence is for the provision of a service for an area consisting of -
(ii) the Bailiwick of Jersey and the Bailiwick of Guernsey, or (iii) the Bailiwick of Jersey, the Bailiwick of Guernsey and the whole or part of the United Kingdom,
as respects such proportion of the amount as the Commission consider appropriate, be paid as mentioned in paragraph (bb) above."; and
(b) in subsection (5) -
(ii) after the words "Auditor General", where they first occur, there shall be inserted "and to the Treasurer of the States of Jersey"; and (iii) after the word "Parliament" there shall be inserted "and the Treasurer of the States of Jersey shall lay copies of the account before the States of Jersey".

In section 39(1), the definitions of "S4C", "on S4C", "S4C Digital" and "on S4C Digital" shall be omitted.
(b) subsections (6) and (7); and (c) in subsection (8), in the definition of "broadcast", paragraph (b) shall be omitted.

In section 41, subsections (4) to (6) shall be omitted.
(c) if the licence is for the provision of a service for an area consisting of -
(ii) the Bailiwick of Jersey and the Bailiwick of Guernsey, or (iii) the Bailiwick of Jersey, the Bailiwick of Guernsey and the whole or part of the United Kingdom,
as respects such proportion of the amount as the Commission consider appropriate, be paid as mentioned in paragraph (bb) above."; and
(b) in subsection (5) -

(b) in subsection (4), for the words "Wales or Northern Ireland" there shall be substituted "Wales, Northern Ireland or the Bailiwick of Jersey".

In section 98, subsections (3) and (4) shall be omitted.
(b) in subsection (2), the words ", the Welsh Authority" shall be omitted.

In section 100(1), after the words "United Kingdom" in both places where they occur there shall be inserted "and the Bailiwick of Jersey".
(b) in subsection (5), paragraph (b) shall be omitted.

In section 108 -
(b) in subsection (5) -
(ii) paragraph (d) and the word ", and" immediately preceding it, shall be omitted.

(ii) at the end there shall be added "or any service broadcast or transmitted for general reception in the Bailiwick of Jersey, or in the Bailiwick of Jersey and the Bailiwick of Guernsey, only"; and
(b) the definition of "relevant cable licence" shall be omitted.

In section 143(1) and (2), the words "or II" shall be omitted.
(b) in subsection (5)(a), the words "or II" shall be omitted; and (c) at the end there shall be added -

(b) subsection (3),
shall be omitted.
(b) in paragraph 21, sub-paragraph (c) and the word "and" immediately preceding it; and (c) paragraphs 22 to 32,

(b) in the repeals of provisions of the Broadcasting Act 1990 -
(ii) the entries relating to sections 47 and 72 and Schedules 19 and 20 shall be omitted.
In the Schedule -
(b) in paragraph 7 (section 24), after the words "(provision of Channel 4)" there shall be inserted "(a)" and at the end there shall be added -
(c) in subsection (6)(a), after the words "United Kingdom" where they first occur insert ", the Bailiwick of Jersey"; and in the second place where they occur, insert "or the Bailiwick of Jersey";";
(c) after paragraph 10, there shall be inserted -
(ii) omit paragraph (b) and the word "or" immediately preceding it;
(b) in subsection (3A), for the words ", a Channel 4 company or an S4C company" substitute "or a Channel 4 company";
(iii) in the definition of "relevant broadcasting body", omit paragraph (c) and the word "and" immediately preceding it.";";
(f) after paragraph 18, there shall be inserted -
(ii) in paragraph (b), after the words "United Kingdom" insert "or the Bailiwick of Jersey"; and
(e) in subsection (3B), paragraph (c) and the word "and" immediately preceding it shall be omitted;";
(h) after paragraph 29, there shall be inserted -
(b) for subsection (6) substitute -
(i) in paragraph 51 (Schedule 2) -
(ii) omit paragraph 4;";
(ii) for sub-paragraph (b) there shall be substituted -
(ii) in paragraph 5A(1), omit paragraph (b) and the word "and" immediately preceding it, and (iii) omit paragraph 5A(3);";
(iii) for sub-paragraph (c) there shall be substituted -
(iii) in paragraph 2(3), in paragraph (a), after the words "United Kingdom" insert "or the Bailiwick of Jersey", and omit paragraph (b) and the word "or" immediately preceding it;";
(iv) for sub-paragraph (d) there shall be substituted -
(ii) in paragraph 2, at the end, add -
(iv) in paragraph 13(2), at the end insert "or the Bailiwick of Jersey and, before making a determination under any of those paragraphs which concerns the public interest in the Bailiwick of Jersey, the relevant authority shall consult the Broadcasting Committee of the States of Jersey";".
(This note is not part of the Order) This Order extends to the Bailiwick of Jersey provisions of the Broadcasting Act 1996 (the 1996 Act) relating to digital terrestrial broadcasting, sporting and other events of national interest, the Broadcasting Standards Commission, and also certain miscellaneous and general provisions. Schedule 1 sets out modifications of provisions of the 1996 Act, and Schedule 2, amending the Broadcasting Act 1990 (Jersey) (No. 2) Order 1991 (S.I. 1991/1710), sets out modifications of the amendments of the Broadcasting Act 1990 made by the 1996 Act. The Order also makes consequential amendments of the Broadcasting Act 1996 (British Broadcasting Corporation - Transmission Network) (Jersey) Order 1997 (S.I. 1997/1757).
