"the 1981 Act" means the British Nationality Act 1981[2];

"the 2002 Act" means the Nationality, Immigration and Asylum Act 2002; and

"application" means an application for registration or naturalisation under any provision of the 1981 Act.

     2. The following provisions of the Nationality, Immigration and Asylum Act 2002 shall come into force on 1st January 2004:

(a) section 3 and Schedule 1; and

(b) section 14.

     3. The provisions commenced by this Order shall not have effect in relation to any application made before 1st January 2004; and any provision of the 1981 Act which is replaced or amended by those provisions, and any subordinate legislation which applies to such a provision of the 1981 Act, shall continue to have effect in relation to such an application as if the replacement or amendment had not been made.

     4. Section 50(8) of the 1981 Act (which makes provision for the date on which an application is made for the purposes of the Act) applies for the purposes of article 3 as it applies for the purposes of that Act.
