(This note is not part of the Order) This Order makes amendments to the Medicines (Monitoring of Advertising) Regulations 1994 ("the principal Regulations") as a consequence of the Communications Act 2003 ("the 2003 Act"). The 2003 Act provides, amongst other things, that OFCOM is to take over the regulatory functions of the Independent Television Commission and the Radio Authority. Furthermore, it confers powers on OFCOM to regulate advertising standards in relation to the Welsh Authority (which was previously self-regulatory in relation to advertising). The amendments to regulations 9 to 11 of the principal Regulations (complaints about / control of certain broadcast advertisements) reflect the above changes. The Order also includes some further minor consequential amendments. A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business. Notes: [1] 2003 c. 21.back [2] S.I. 1994/1933, to which there are amendments not relevant to this Order.back
