The Secretary of State, in exercise of the powers conferred upon him by section 1(1) of, and paragraphs 10 and 11(1)(c) of Schedule 1 to, the Building Act 1984[1], and of all other powers enabling him in that behalf, after consulting the Building Regulations Advisory Committee, such persons or bodies as appear to him to be representative of local authorities and such other bodies as appear to him to be representative of the interests concerned in accordance with section 14(4) of that Act[2], and being satisfied that certain provisions of local Acts are unnecessary in consequence of building regulations, hereby makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the Building (Repeal of Provisions of Local Acts) Regulations 2003 and shall come into force on 1st March 2004. Repeal of certain provisions of local Acts 2. The following local Acts are repealed to the extent specified in the third column -
Transitional provisions 3. Where before 1st March 2004 -
(b) no notice rejecting those plans has been given under section 16(6) of the Building Act 1984 before that date,
then that provision and any right, privilege, obligation or liability arising from it shall cease to have effect in relation to that deposit of plans. (This note is not part of the Regulations) These Regulations repeal certain local Act provisions relating to the provision of separate drains for foul water and surface water, which are unnecessary as a result of Part H of Schedule 1 to the Building Regulations 2000 (S.I. 2000/2531; Part H was substituted by the Building (Amendment) Regulations 2001 (S.I. 2001/3335)). Regulation 3 contains transitional provisions. A regulatory impact assessment has been prepared in relation to the repeal of these local Act provisions.
