In exercise of the powers conferred upon the Secretary of State by sections 118(1), 120(1) and (3), 121(1) and 138(7) of the School Standards and Framework Act 1998[1] the Secretary of State for Education and Skills hereby makes the following Regulations: Citation and commencement 1. - (1) These Regulations may be cited as the Education (Nursery Education and Early Years Development) (England) (Amendment) Regulations 2003. (2) These Regulations except for regulation 2(3) shall come into force on 1st January 2004. (3) Regulation 2(3) shall come into force on 1st April 2004. Amendment of the Education (Nursery Education and Early Years Development) (England) Regulations 1999 2. - (1) The Education (Nursery Education and Early Years Development) (England) Regulations 1999[2] shall be amended as follows. (2) In regulation 1(3) the definitions of "the partnership" and "statement of proposals" shall be omitted. (3) In regulation 2(1)(a) and (b) for "fourth birthday" (in each case where the words occur) substitute "third birthday". (4) Regulation 3 and the Schedule shall be omitted. (5) Regulation 4 shall be omitted. Revocation of the Education (Nursery Education and Early Years Development) (England) (Amendment) Regulations 2002 3. The Education (Nursery Education and Early Years Development) (England) (Amendment) Regulations 2002[3] are revoked. Cathy Ashton Parliamentary Under Secretary of State, Department for Education and Skills 13th November 2003 (This note is not part of the Regulations) These Regulations amend the Education (Nursery Education and Early Years Development) (England) Regulations 1999. Regulation 2(3), which comes into force on 1st April 2004, amends the minimum age in relation to which local education authorities must secure sufficient provision of nursery education for children in their area (required by section 118 of the School Standards and Framework Act 1998). The other provisions of these Regulations, which come into force on 1st January 2004, remove the requirement to produce an Early Years Development and Childcare Plan at intervals of one year.
