Her Majesty, in pursuance of sections 4(2) and 5(9) of the Parliamentary Commissioner Act 1967[1], is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows: - 1. This Order may be cited as the Parliamentary Commissioner Order 2003 and shall come into force on 16th December 2003. 2. The Parliamentary Commissioner Act 1967 shall be amended as follows. 3. Traffic Commissioners appointed under section 4 of the Public Passenger Vehicles Act 1981[2] Adjudicators appointed under article 7 (1) (b) of the Criminal Injuries Compensation (Northern Ireland) Order 2002 [3] (b) delete the following entries: - Pensions Appeal Tribunal for Scotland constituted under section 6 of, and the Schedule to, the Pensions Appeal Tribunals Act 1943[4] Financial Services Tribunal constituted under section 96 of the Financial Services Act 1986[5] (c) for "Special Educational Needs Tribunal constituted under section177 of the Education Act 1993" substitute "Special Educational Needs and Disability Tribunal".
(This note is not part of the Order) This Order amends the Parliamentary Commissioner Act 1967. It adds the bodies referred to in article 3(a) to the list of departments and authorities which are subject to investigation by the Parliamentary Commissioner for Administration; deletes from that list those bodies referred to in article 3(b); and amends those entries in the list referred to in articles 3(c) to (k). This Order deletes Notes 4 and 8A from Schedule 2 and inserts a new Note A2 as referred to in articles 3(l) to 3 (n). This Order adds the tribunals referred to in article 4(a) to the list of tribunals whose administrative functions may be subject to investigation by the Parliamentary Commissioner for Administration under the terms of section 5 (7). The tribunals referred to in article 4(b) of this order are deleted from that list. The entry in respect of the tribunal referred to in article 4(c) is amended.
