The Secretary of State for Health, in exercise of the powers conferred on him by sections 20(2)(g) and (9) and 38(7) of the National Health Service Reform and Health Care Professions Act 2002[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations: Citation, commencement, application and interpretation 1. - (1) These Regulations may be cited as the Commission for Patient and Public Involvement in Health (Functions) Amendment (No. 2) Regulations 2003 and shall come into force on 1st September 2003. (2) These Regulations apply to England only. (3) In these Regulations, "the principal Regulations" means the Commission for Patient and Public Involvement in Health (Functions) Regulations 2002[2]. Insertion of regulation 1A in the principal Regulations 2. After regulation 1 of the principal Regulations (citation, commencement, application and interpretation) there shall be inserted -
1A. - (1) It is also the function of the Commission -
(b) to make to the Secretary of State such reports or recommendations as the Commission thinks fit concerning any matters relating to such contracts.
(2) This regulation shall cease to have effect on 31st August 2005.".
Amendment of regulation 2 of the principal Regulations
(b) at the end there shall be added the following paragraph -
(This note is not part of the Regulations) These Regulations amend the Commission for Patient and Public Involvement in Health (Functions) Regulations 2002 ("the principal Regulations"). Regulation 2 confers on the Commission an additional function of managing and monitoring contracts entered into by the Secretary of State for the provision of independent advocacy services and of making reports and recommendations to the Secretary of State on such contracts. Regulation 3 amends the provisions in regulation 2 of the principal Regulations (annual work programme) to provide that the work programme shall also cover arrangements for carrying out this additional function.
