Whereas the Secretary of State for Education and Skills has received a proposal from the Learning and Skills Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992[1] ("the Act"), for the establishment of a body corporate under section 16(1)(a) of the Act; Now, therefore, in exercise of the powers conferred on him by sections 16(1) and 17 of the Act and for the purpose of giving effect to that proposal, the Secretary of State hereby makes the following Order: 1. This Order may be cited as the Oxford and Cherwell College (Incorporation) Order 2003 and shall come into force on 1st April 2003 ("the commencement date"). 2. There shall be established as from the commencement date a body corporate called "Oxford and Cherwell College", for the purpose of establishing and conducting as from the operative date a new educational institution of that name. 3. The operative date in relation to the further education corporation established by this Order shall be 1st August 2003, and the corporation shall conduct Oxford and Cherwell College from that date.
