Education (London Residuary Body) (Property Transfer) (Amendment No. 2) Order 2002

In exercise of the powers conferred on the Secretary of State by sections 187(5), (6) and (7), 231(2) and 232(5) of the Education Reform Act 1988[1] the Secretary of State for Education and Skills hereby makes the following Order:

     1. This Order may be cited as the Education (London Residuary Body) (Property Transfer) (Amendment No. 2) Order 2002 and shall come into force on 29th November 2002.

    
2. The Education (London Residuary Body) (Property Transfer) Order 1992[2] is amended by deleting article 4(6)(a)[3].

EXPLANATORY NOTE

(This note is not part of the Regulations)


This Order amends the Education (London Residuary Body) (Property Transfer) Order 1992.

The 1992 Order (as amended by S.I. 2002/2003, article2) transferred land described as the former Henry Thornton Secondary School, 45 Clapham Common South Side, London SW4 to the London Borough of Lambeth. Transfer was made subject to the following conditions:

    (a) That the part of the land which abuts Clapham Common South Side and is registered under title number TGL 150604 at HM Land Registry shall be brought into use wholly or mainly for the purposes of an institution for the full-time education of persons over compulsory school age who have not attained the age of nineteen years.

    (b) That part of the land which abuts Elms Road and is registered under title number SGL 35568 at HM Land Registry shall by 1st September 2006 be brought into use wholly or mainly for the purposes of an institution for full- time education.

The Order further provided that if the land were not brought into use in accordance with these conditions, it should be disposed of and the proceeds of sale (after deductions) should be divided between the Councils of the Inner London Boroughs and the Common Council of the City of London.

In 1998, that part of the land which is subject to condition (a) above was transferred to Lambeth College.

This Order amends the condition in relation to that part of the land owned by Lambeth College by removing the restriction on the use to the full-time education of persons over compulsory school age who have not attained the age of 19 years.
