ROAD TRAFFIC

Road Vehicles (Testing) (Disclosure of Information) (Great Britain) Regulations 2002

The Secretary of State for Transport, being the Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972 in relation to measures relating to the testing of the roadworthiness of motor vehicles and their trailers and in exercise of the powers conferred upon him by section 2(2) of the European Communities Act 1972[2] hereby makes the following Regulations:

Citation, commencement and extent
     1.  - (1) These Regulations may be cited as the Road Vehicles (Testing) (Disclosure of Information) (Great Britain) Regulations 2002 and shall come into force on 15th October 2002.

    (2) These regulations do not extend to Northern Ireland.

Disclosure of testing information to member state competent authorities
    
2. The Secretary of State may give information about vehicles or persons obtained from tests and inspections carried out under section 67 or 68 of the Road Traffic Act 1988 or under section 1 of the Road Traffic (Foreign Vehicles) Act 1972[3] to the competent authorities in other member States, and in Northern Ireland and Gibraltar, in compliance with Directive 2000/30/EC of the European Parliament and of the Council, on the technical roadside inspection of the roadworthiness of commercial vehicles circulating in the Community[4].

EXPLANATORY NOTE

(This note is not part of the Regulations)


These regulations complete the transposition in Great Britain of Directive 2000/30 of the European Parliament and of the Council, allowing the Secretary of State as competent authority in Great Britain to give information obtained in the course of testing and inspecting commercial vehicles for their roadworthiness to be passed to the competent authorities in other member States and in Northern Ireland and Gibraltar. Other provisions of the Directive are already incorporated as respects Great Britain under sections 66A to 73 of the Road Traffic Act 1988, the Road Vehicles (Construction and Use) Regulations 1986[
5] the Road Vehicles Lighting Regulations 1989[6] and the Road Traffic (Foreign Vehicles) Act 1972.
