The Education (Grants in respect of Voluntary Aided Schools) (Amendment) (England) Regulations 2002

  Coming into force 1st August 2002 

In exercise of the powers conferred on the Secretary of State by section 138(7) of, and paragraph 5 of Schedule 3 to, the School Standards and Framework Act 1998[1] the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation and Commencement
     1. These Regulations may be cited as the Education (Grants in respect of Voluntary Aided Schools) (Amendment) (England) Regulations 2002 and shall come into force on 1st August 2002.

Amendment of the Education (Grants in respect of Voluntary Aided Schools) Regulations 1999
    
2.  - (1) The Education (Grants in respect of Voluntary Aided Schools) Regulations 1999[2] shall be amended in relation to England as follows:

    (2) In regulation 2(1) - 

    (a) in the definition of "eligible expenditure" for "qualifying expenditure" there shall be substituted "capital expenditure";

    (b) before the definition of "relevant school" there shall be inserted - 

      " "relevant percentage" is a percentage determined by the Secretary of State being not less than 85%".

    (3) In regulation 3(1) - 

    (a) for "qualifying expenditure" there shall be substituted "capital expenditure"; and

    (b) for "85%" there shall be substituted "the relevant percentage".

    (4) In regulation 3(2) for "qualifying expenditure" there shall be substituted "capital expenditure".

EXPLANATORY NOTE

(This note is not part of the Regulations)


The Regulations amend the Education (Grants in respect of Voluntary Aided Schools) Regulations 1999 in respect of England, which are as a consequence of amendments to the School Standards and Framework Act 1998 made by the Regulatory Reform (Voluntary Aided Schools Liabilities and Funding) (England) Order 2002.
