ROAD TRAFFIC

The Road Vehicles (Construction and Use) (Amendment) (No. 2) Regulations 2002

  for the purpose of Regulation 4 1 August 2002 

The Secretary of State for Transport, in exercise of the powers conferred by sub-sections (1), (2) and (5) of section 41 of the Road Traffic Act 1988[1] and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 2) Regulations 2002. Regulations 2, 3 and 5 shall come into force on 1 July 2002 and for the purpose of Regulation 4 shall come into force on 1st August 2002.

Amendment to Regulation 61A
    
2.  - (1) Regulation 61A of the Road Vehicles (Construction and Use) Regulations 1986[2] shall be amended by the insertion in the third column of the Table the entry specified below.

    (2) In item 2, after the last entry there shall be inserted

      " 2001/27/EC"

Amendment to Schedule 2
     3. In Table 1 in Schedule 2, after item 81 there shall be inserted the following item - 

"82 2001/27 10.4.01 L107, 18.4.2001 p.10 Measures to be taken against the emission of gaseous and particulate pollutants from compression- ignition engines for use in vehicles, and the emission of gaseous pollutants from positive-ignition engines fuelled with natural gas or liquefied petroleum gas for use in vehicles 88/77 as amended by 91/542 and 1999/96"


Amendment to Schedule 7B (emissions from certain motor vehicles)
    
4. In Schedule 7B, in paragraph 7, for sub-paragraph (b) there shall be substituted the following sub-paragraph - 

Amendment of Regulation 15 (braking systems of certain vehicles first used on or after 1st April 1983)
    
5. In paragraph (1E) of Regulation 15, for the word "April" there shall be substituted "May".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations further amend the Road Vehicles (Construction and Use) Regulations, 1986 ("the 1986 Regulations").

Regulation 2 adds a reference to Directive 2001/27/EC into item 2 of the Table in Regulation 61A of the 1986 Regulations, specifying requirements in relation to smoke, gas and other similar emissions. The requirements have effect on heavy-duty vehicles and amend certain technical requirements in order to prevent cycle defeating strategies being employed in compression ignition engines, and to simplify certain construction requirements for gas engines. Limit values specified in Annex I to Directive 1988/77/EEC as amended by Directive 1999/96/EC remain unchanged, but the new requirements set out in Directive 2001/27/EC apply to gas engines from 1st October 2003.

Regulation 3 adds that Directive to the list of Community Directives specified in Schedule 2.

Regulation 4 amends the definition of "the emissions publication" in Schedule 7B of the 1986 Regulations so as to refer to the most recent (ie the eighth) edition of the publication entitled "In-Service Exhaust Emission Standards for Road Vehicles". The publication specifies, with respect to vehicles with spark ignition engines, the maximum permitted carbon monoxide content of exhaust emissions at idling speed and the limits for the ratio of air to petrol vapour entering the combustion chamber, in relation to each of the vehicle models named in the publication.

Regulation 5 corrects a minor error introduced by S.I. 2001/3208 into paragraph (1D) of Regulation 15 of the 1986 Regulations concerning braking systems of certain vehicles.

In relation to the amendments specified in Regulations 2 and 3, a Regulatory Impact Assessment has been prepared and copies can be obtained from the Department for Transport, Local Government and the Regions, Zone 4/15, Great Minster House, 76 Marsham Street, London SW1P 4DR (telephone: 020 7944-2063). Copies are being placed in the libraries of each House of Parliament. No separate transposition note has been provided since all the relevant information is contained within this Explanatory Note.
