JUSTICES OF THE PEACE, ENGLAND AND WALES

Commission Areas (West Mercia) Order 2002

  Made 27th May 2002 
  Laid before Parliament 30th May 2002 
  Coming into force 21st June 2002 

Whereas the West Mercia magistrates' court committee have, in pursuance of section 32A(1) of the Justices of the Peace Act 1997[1] submitted to the Lord Chancellor written proposals for the alteration of commission areas including parts of the area for which they are the committee:

     And whereas by section 32A(4) and (5) of the Act it is provided that any order made by the Lord Chancellor under section 1(2) of that Act shall be taken to implement such proposals if it does so either without changes or only with changes which do not appear to him to be important and that any such order may contain such consequential and transitional provisions as appear to him to be necessary or expedient:

     And whereas the provisions of sections 32A(2) of that Act have been complied with:

     Now, therefore, the Lord Chancellor, in exercice of the powers conferred upon him by section 1(2) of that Act, makes the following Order:

     1. This Order may be cited as the Commission Areas (West Mercia) Order 2002 and shall come into force on 21st June 2002.

    
2. In this Order - 

    "area" means a commission area including any part of the West Mercia magistrates' courts committee area;

    "abolished area" means an area abolished by article 3(a) below;

    "new area" means the area constituted by article 3(b) below;

any reference to a justice for an area shall be construed as a reference to a person who holds the commission of the peace for that area.

    
3. In Part 1 of the Schedule to the Justices of the Peace (Commission Areas) Order 1999[2]:

    (a) the entries for Hereford and Worcester and Shropshire shall be omitted;

    (b) after the entry for Warwickshire there shall be inserted the following new entry:

    Name of commission area Extent of commission area
    West Mercia The area of West Mercia MCC

     4. Every person who immediately before 21st June 2002 holds office as a justice of the peace for an abolished area shall on and after that date hold office as a justice of the peace for the new area, and the commissions for the peace for the abolished areas shall accordingly have effect as commissions of the peace for the new area until such time as a commission of the peace for that area is granted.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order provides for the replacement of the two commission areas of Hereford and Worcester and Shropshire by a single commission area to be know as the West Mercia commission area, and comes into force on 21st June 2002.
