SOCIAL CARE

The Health and Social Care Act 2001 (Commencement No. 9) Order 2002

  Made 14th April 2002 

The Secretary of State for Health, in exercise of the powers conferred upon him by section 70(2) of the Health and Social Care Act 2001[1], hereby makes the following Order:

Citation, interpretation and extent
     1.  - (1) This Order may be cited as the Health and Social Care Act 2001 (Commencement No. 9) Order 2002.

    (2) In this Order - 

    "the Act" means the Health and Social Care Act 2001.

    (3) Article 2 of this Order extends to England and Scotland only[2].

    (4) Article 3(a) and (c) of this Order extend to England and Wales only[3].

    (5) Article 3(b) and (d) of this Order extend to Scotland only.

    (6) Article 3(e) of this Order extends to England, Scotland and Wales.

Appointed day in respect of section 62 of the Act
     2. 15th April 2002 is the appointed day for the coming into force of section 62 of the Act.

Appointed day in respect of section 67(2) of, and Schedule 6, to the Act
    
3. 15th April 2002 is the appointed day for the coming into force of subsection (2) of section 67 of, and Part 3 of Schedule 6 to, the Act in respect of the repeal of - 

    (a) section 26A of the National Assistance Act 1948[4];

    (b) section 86A of the Social Work (Scotland) Act 1968[5];

    (c) section 43 of the National Health Service and Community Care Act 1990[6];

    (d) section 57 of the National Health Service and Community Care Act 1990; and

    (e) section 135(3) and (4) of the Social Security Contributions and Benefits Act 1992[7].

EXPLANATORY NOTE

(This note is not part of the Order)


This Order is the ninth Commencement Order under the Health and Social Care Act 2001 ("the Act").

Article 2 brings into force, in relation to England and Scotland, section 62 of the Act.

Article 3 brings into force the provisions effecting the repeal of certain enactments specified in Schedule 6 to the Act.
