The Secretary of State for Trade and Industry, with the consent of the Treasury, in exercise of the powers conferred on her by section 56(1) and (2) of the Finance Act 1973[1] and of all other powers enabling her in that behalf, hereby makes the following Regulations: 1. These Regulations may be cited as the Measuring Instruments (EEC Requirements) (Fees) (Amendment) Regulations 2002 and shall come into force on 1st April 2002. 2. The Measuring Instruments (EEC Requirements) (Fees) Regulations 1998[2] are hereby amended as follows -
(b) in paragraph 1(a) respectively in Schedules 2, 3, 5 and 6, for the words "£70.00 per hour" there shall be substituted "£77.00 per hour" in all places where those words occur.
(This note is not part of the Regulations) These Regulations amend the Measuring Instruments (EEC Requirements) (Fees) Regulations 1998 (S.I. 1998/1177), as amended by the Measuring Instruments (EEC Requirements) (Fees) (Amendment) Regulations 1999 (S.I. 1999/861), the Measuring Instruments (EEC Requirements) (Fees) (Amendment) Regulations 2000 (S.I. 2000/689), and the Non-automatic Weighing Instruments Regulations 2000 (S.I. 2000/3236), (the principal Regulations). These Regulations make a minor amendment to correct a typographical error in paragraph 1 in Schedule 2 to the principal Regulations and provide for a further increase in the fees in respect of services provided by the Department of Trade and Industry in relation to the type approval and testing of measuring instruments. The hourly rate (as specified in paragraph 1(a) respectively in Schedules 2, 3, 5 and 6 to the principal Regulations) for those services is increased from £70.00 to £77.00 (an increase of £7.00) and is the second increase since 1st June 1998 (when the principal Regulations came into force); the first increase (from £65.00 to £70.00) came into force on 1st April 2000.
