The General Medical Council (Professional Performance) (Amendment) Rules Order of Council 2001

At the Council Chamber, Whitehall, the 20th day of November 2001

By the Lords of Her Majesty's Most Honourable Privy Council

Whereas in pursuance of paragraphs 1(1), 1(2A) and 5A(1) of Schedule 4 to the Medical Act 1983[1] the General Medical Council, having consulted with such bodies of persons representing medical practitioners as appeared to the said Council to be requisite, have made the General Medical Council (Professional Performance) (Amendment) Rules 2001 as set out in the Schedule to this Order:

     And whereas by paragraph 1(5) of the said Schedule 4 such Rules shall not come into force until approved by Order of the Privy Council:

     Now, therefore, Their Lordships, having taken the said Rules into consideration, in exercise of the powers conferred by the said paragraph 1(5), do hereby approve the same:

This Order may be cited as the General Medical Council (Professional Performance) (Amendment) Rules Order of Council 2001, and shall come into force on 12th December 2001.

SCHEDULE

THE GENERAL MEDICAL COUNCIL (PROFESSIONAL PERFORMANCE) (AMENDMENT) RULES 2001


     The General Medical Council in exercise of their powers under paragraph 1(1), 1(2A) and 5A(1) of Schedule 4 to the Medical Act 1983[
2], and after consulting such bodies of persons representing medical practitioners as appeared to the Council to be requisite, hereby make the following Rules - 
Citation and commencement
     1. These rules may be cited as the General Medical Council (Professional Performance) (Amendment) Rules 2001, and shall come into force on 12th December 2001.

Amendment of the General Medical Council (Professional Performance) Rules 1997
     2.  - (1) The General Medical Council (Professional Performance) Rules 1997[3] shall be amended as follows.

    (2) The following rule shall be substituted for rule 6(1) - 

      " An assessment may be carried out otherwise than in accordance with a direction at this stage in the consideration of a case for the purposes of paragraph 5A(1)(b) of Schedule 4 to the Act where either the medical screener is of the opinion that an assessment needs to be carried out, or the case is one to which rule 5(8) applies.".

EXPLANATORY NOTE

(This note is not part of the Order)


The Rules approved by this Order amend the General Medical Council (Professional Performance) Rules 1997 (annexed to S.I. 1997/1529). The amendments clarify provisions governing invitations to medical practitioners to undergo assessment of their performance.
