The Secretary of State for Education and Skills, in exercise of the powers conferred on her by section 483(3A) of the Education Act 1996[1], hereby makes the following Order: 1. This Order may be cited as the Education (City Academies) Order 2001 and shall come into force on 12th November 2001. 2. In its application to a City Academy, section 483(3) of the Education Act 1996 shall be modified by the deletion of the word "and" at the end of paragraph (a) and by the addition of the following words -
(d) the extent to which, in the opinion of the Secretary of State, the sums to be repaid should instead be paid to the Local Education Authority for the area in which the City Academy is situated or should be retained by the City Academy for charitable purposes.".

This Order applies only to England. (This note is not part of the Order) This Order modifies the application of s.483(3) of the Education Act in its application to City Academies which are established under s.482 of that Act.
