The Food Industry Development (Amendment) (England) Scheme 2001

  Coming into force 29th October 2001 

The Minister of Agriculture, Fisheries and Food, in exercise of the power conferred by section 50 (1), (2) and (3) of the Agriculture Act 1993[1], and now vested in her[2], and with the approval of the Treasury, hereby makes the following Scheme - 

Title, commencement and extent
     1.  - (1) This Scheme may be cited as the Food Industry Development (Amendment) (England) Scheme 2001 and shall come into force on 29th October 2001.

    (2) This Scheme applies to England.

Amendment of the Food Industry Development Scheme 1997
    
2. The Food Industry Development Scheme 1997[3] (hereinafter referred to as "the Scheme") shall have effect subject to the amendments contained in paragraphs 3 and 4.

     3. In paragraph 5 (eligibility for consideration for the payment of a grant under the Scheme), at the end of sub-paragraph (2) there shall be inserted the words "and that the applicant falls within any class or classes to which the Minister has restricted applications under paragraph 6(2A)".

    
4. In paragraph 6 (applications for grants under the Scheme), after sub-paragraph (2) there shall be inserted the following sub-paragraph - 

        " (2A) An invitation by the appropriate Minister for applications for the payment of a grant under this Scheme may be restricted to such class or classes of person as that Minister shall determine.".

EXPLANATORY NOTE

(This note is not part of the Scheme)


This Scheme, which applies to England, comes into force on 29th October 2001 (paragraph 1).

The Scheme amends the Food Industry Development Scheme 1997, insofar as the latter applies to England, by specifying that eligibility for consideration for the payment of a grant under that Scheme may be restricted, in any invitation for applications for such a payment, to such class or classes of person as the appropriate Minister (who, in England, is the Minister of Agriculture, Fisheries and Food) shall determine (paragraphs 3 and 4).
