NATIONAL ASSISTANCE, ENGLAND

The Health and Social Care Act 2001 (Commencement No. 2) (England) Order 2001

  Made 9th September 2001 

The Secretary of State for Health, in exercise of the powers conferred upon him by section 70(2) of the Health and Social Care Act 2001[1], hereby makes the following Order: - 

Citation, interpretation and extent
     1.  - (1) This Order may be cited as the Health and Social Care Act 2001 (Commencement No. 2) (England) Order 2001.

    (2) In this Order, "the Act" means the Health and Social Care Act 2001.

    (3) This Order extends to England only.

Appointed Day
    
2. The day appointed for the coming into force of the provisions of the Act specified in the Schedule to this Order is 1st October 2001.

PROVISIONS OF THE ACT COMING INTO FORCE ON 1st OCTOBER 2001


Provisions of the Act Subject matter
section 53 Disregarding of resources when determining need for residential accommodation
section 54 in so far as it has not already been brought into force by section 70(2) Funding by resident etc. of more expensive accommodation
section 55(1) to (6) and (8) but only for the purpose of enabling a local authority to enter into a deferred payment agreement with a resident who has a beneficial interest in property which he occupies or formerly occupied as his only or main residence Power for local authorities to take charges on land instead of contributions



EXPLANATORY NOTE

(This note is not part of the Order)


This Order is the second Commencement Order made under the Health and Social Care Act 2001 ("the Act")

This Order brings into force in England, on 1st October 2001, section 53 of the Act which relates to the disregarding of resources when determining need for residential accommodation under section 21 opf the National Assistance Act 1948; section 54 of the Act in so far as it has not already been brought into force by section 70(2) of the Act, which relates to the power for local authorities to take charges on land instead of contributions from residents, but only for the purposes stated in the Schedule.
