The Secretary of State, in exercise of the powers conferred upon him by section 232(3) of the Housing Act 1996[1] and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation
1. This Order may be cited as the Housing Act 1996 (Commencement No. 13) Order 2001.
Commencement
2. The following provisions of the Housing Act 1996 shall come into force on 15th October 2001 -
-
section 155 to the extent that it is not already in force[2],
-
section 156.

This Order brings into force on 15th October 2001 those provisions of the Housing Act 1996 which are not already in force.
The provisions are section 155 (arrest and remand), to the extent that it does not already have effect, and section 156 (remand for medical examination and report). It thereby also brings Schedule 15 (arrest for anti-social behaviour: powers of high court and county court to remand) into force. The effect of this Order is to allow an applicant to apply to the court for a warrant for arrest of a person in breach of an injunction made by virtue of section 152(6) or section 153 of the Housing Act 1996 where a power of arrest could have been, but was not attached. Further, a court is able to remand a person arrested for breach of an injunction made under those sections.
