The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred upon him by sections 405(2), 406, 408(1) and (7), and 420(1) of the Greater London Authority Act 1999[1], and of all other powers enabling him in that behalf, hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Greater London Authority (Miscellaneous Amendments) Order 2001 and shall come into force on 14th August 2001. Amendment of instruments 2. The amendments of the instruments indicated in the Schedule to this Order shall have effect. Signed by authority of the Secretary of State for Transport, Local Government and the Regions David Jamieson Parliamentary Under-Secretary of State Department for Transport, Local Government and the Regions 18th July 2001 1. - (1) The GLA Roads Designation Order 2000[2] shall be amended in accordance with the following provisions of this paragraph. (2) In paragraph 54 (designation of A312 as a GLA road) of the Schedule, after "with Western Avenue (A40)", there shall be inserted "excluding the roundabout at the junction with the M4 Motorway". (3) In paragraph 55 (designation of A316 as a GLA road) of the Schedule, after "Chiswick Square" omit the words "excluding the roundabout at the junction with the M4 Motorway". 2. In the GLA Roads and Side Roads (Transfer of Property etc.) Order 2000[3] (property transferred in relation to GLA roads and side roads) after article 5 there shall be inserted -
5A. Where any property transferred to Transport for London by or under articles 2 to 4 above from the Secretary of State as former highway authority was on the operative date subject to a residential tenancy, the interest of the landlord under that tenancy shall be treated for the purposes of paragraph 11 of Schedule 1 to the Housing Act 1988[4] (Crown tenancies entered into after commencement of Part I of that Act not to be assured tenancies) or of section 13 of the Rent Act 1977[5] (earlier Crown tenancies not to be protected tenancies) as if it belonged to the Secretary of State and not to Transport for London.".
(This note is not part of the Order) This Order makes incidental, consequential, and supplementary provision for the general or particular purposes of the Greater London Authority Act 1999 ("the 1999 Act"), and for giving full effect to that Act. It does so by amending the instruments specified in the Schedule to the Order. Paragraph 1 of the Schedule corrects a minor error in the GLA Roads Designation Order 2000 relating to a roundabout at the junction with the M4 motorway. Paragraph 2 of the Schedule amends the GLA Roads and Side Roads (Transfer of Property etc.) Order 2000 so that the landlord's interest in any residential tenancy transferred by the Order to Transport for London is that of a public landlord (as it was before the tenancy transferred).
