Whereas it has been made to appear to Her Majesty that by reason of urgency this Order requires to be made without a draft having been approved by resolution of each House of Parliament: Now, therefore, Her Majesty, in exercise of the powers conferred by section 85 of the Northern Ireland Act 1998[1], is pleased by, and with the advice of Her Privy Council, to order, and it is hereby ordered as follows: 1. - (1) This Order may be cited as the Police (Northern Ireland) Order 2001 and comes into force on 30th July 2001. (2) In this Order "the Act" means the Police (Northern Ireland) Act 2000[2]. 2. At any time before section 2 of the Act comes into force section 41 of the Act has effect as if references in it to the Board were references to the Police Authority for Northern Ireland. 3. For section 76(4) of the Act there is substituted -

In article 60(4) of the Firearms (Northern Ireland) Order 1981[3] after "police force" there is inserted, "a police trainee or a police reserve trainee". (This note is not part of the Order) This Order amends two provisions of the Police (Northern Ireland) Act 2000. Section 41, which deals with trainees, is amended so that, before the Northern Ireland Policing Board is established, references to the Board are to be construed as references to the Police Authority for Northern Ireland. Section 76 is amended so that draft orders under sections 47(3) (renewal of temporary provisions on recruitment) and 54 (emblems and flags) are subject to the affirmative resolution procedure rather than the procedure provided for in section 6 of the Statutory Instruments Act 1946. The Order also amends the Firearms (Northern Ireland) Order 1981 to include police trainees and police reserve trainees in the provision which exempts police officers from the need for a firearm certificate.
