Whereas the Secretary of State, for a reason affecting the public interest, deems it necessary in the public interest to restrict flying in the vicinity of certain prisons specified in the Second Schedule hereto: Now therefore the Secretary of State, in exercise of the powers conferred on him by article 85 of the Air Navigation Order 2000[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations: 1. These Regulations may be cited as the Air Navigation (Restriction of Flying) (Prisons) Regulations 2001 and shall come into force on 11th May 2001. 2. The Regulations specified in the First Schedule hereto are hereby revoked. 3. - (1) This regulation applies to each of the prisons specified in column 1 of the Second Schedule hereto, each of which for the purpose of this regulation shall be taken to comprise either an area bounded by a circle of the radius specified in column 2 of the said Schedule opposite its name centred on the position so specified in column 3 of the said Schedule or in the case of Altcourse, Belmarsh and Frankland the area described in column 2 of the said Schedule. (2) Subject to paragraph (3), no helicopter shall fly over a prison to which this regulation applies below such height above mean sea level as is specified in column 4 of the said Schedule opposite its name. (3) Nothing in this regulation shall prohibit:
(b) flight by any helicopter operated by or on behalf of a police force for any area of the United Kingdom; or (c) in relation to the high security prison at Belmarsh; flight by any helicopter flying in accordance with the Instrument Flight Rules and in accordance with instructions given by the air traffic control unit at London City airport.
(This note is not part of the Regulations) These Regulations revoke and replace the Air Navigation (Restriction of Flying) (High Security Prisons) Regulations 1989, as amended. In addition to some minor drafting amendments, the following changes are made: (1) The Regulations do not apply to HMP Parkhurst. (2) Restrictions are introduced in respect of Her Majesty's Prisons at Altcourse, Bristol, Doncaster, High Down, Manchester, Wakefield and Woodhill. (3) The area within which restrictions apply in respect of HMP Frankland is extended to encompass HMP Durham.
