LOCAL GOVERNMENT, ENGLAND AND WALES

The Elections Act 2001 (Supplemental Provisions) Order 2001

  Made 30th April 2001 
  Laid before Parliament 4th May 2001 
  Coming into force 25th May 2001 

The Secretary of State, in exercise of the powers conferred upon him by section 7(1) and (2) of the Elections Act 2001[1], hereby makes the following Order:

     1.  - (1) This Order may be cited as the Elections Act 2001 (Supplemental Provisions) Order 2001.

    (2) This Order shall come into force on 25th May 2001.

    (3) This Order extends to England and Wales only.

    
2. Paragraph 6A(1) of Schedule 12 to the Local Government Act 1972 (date of annual meeting of joint authorities etc)[2] shall be modified so as to have effect for the year 2001 as if for "and 30th June" there were substituted "and 31st August".

     3. Paragraph 7(2) of Schedule 12 to the Local Government Act 1972 (date of annual meeting of parish councils in years where there is no ordinary election) shall be modified so as to have effect for the year 2001 as if after the words "in May" there were inserted "or June".

    
4. Paragraph 23(2) of Schedule 12 to the Local Government Act 1972 (date of annual meeting of community councils in years where there is no ordinary election) shall be modified so as to have effect for the year 2001 as if after the words "in May" there were inserted "or June".

EXPLANATORY NOTE

(This note is not part of the Order)


The Elections Act 2001 postponed certain local government elections from 3rd May 2001 to 7th June 2001. This postponement also has an impact on the dates by which annual meetings must be held by joint authorities, police authorities and certain parish and community councils. This Order modifies three provisions in the Local Government Act 1972 relating to such meetings. The date by which a joint authority or police authority must hold its annual meeting in 2001 is extended to 31st August, and the date by which a parish or community council which is not holding ordinary elections in 2001 must hold its annual meeting is extended to the end of June.
