The Secretary of State, in exercise of the powers conferred on him by section 24(2) of the Health and Safety at Work etc. Act 1974[1], sections 1(1), 4(6) and (6A), 7(1), (3) and (5), 9(1), (2) and (4), 10(2), (5), (6) and (7), 10A(1), 11(1), 12(2), 13, 19 and 41(4) of the Employment Tribunals Act 1996[2] and paragraph 37 of Schedule 6 to the Scotland Act 1998[3], and of all other powers enabling him in that behalf, and after consultation with the Council on Tribunals, hereby makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the Employment Tribunals (Constitution and Rules of Procedure) (Scotland) (Amendment) Regulations 2001 and shall come into force on 16th April 2001. Amendment of the Employment Tribunals (Constitution and Rules of Procedure) (Scotland) Regulations 2001 2. Regulation 1(2) of the Employment Tribunals (Constitution and Rules of Procedure) (Scotland) Regulations 2001[4] shall be amended by the substitution of the words "16th July 2001" for the words "18th April 2001". Stephen Byers, Secretary of State for Trade and Industry 11th April 2001 (This note is not part of the Regulations) These Regulations amend the Employment Tribunals (Constitution and Rules of Procedure) (Scotland) Regulations 2001 (S.I. 2001/1170 S. 7) by changing the coming into force date of those Regulations from 18th April 2001 to 16th July 2001. Notes: [1] 1974 c. 37; "prescribed" is defined by section 53(1) of the Act as meaning prescribed by regulations.back [2] 1996 c. 17; by virtue of section 1 of the Employment Rights (Dispute Resolution) Act 1998 (c. 8) industrial tribunals were renamed employment tribunals and references to "industrial tribunal" and "industrial tribunals" in any enactment were substituted with "employment tribunal" and "employment tribunals". Section 4(6) was amended by paragraph 12(4) of Schedule 1 to the Employment Rights (Dispute Resolution) Act 1998 and section 4(6A) was inserted by section 3(6) of that Act. Section 7 was interpreted by section 239(4) of the Trade Union and Labour Relations (Consolidation) Act 1992 (c. 52), as inserted by paragraph 1 of Schedule 5 to the Employment Relations Act 1999 (c. 26). Section 9(4) was amended by paragraph 15 of Schedule 1 to the Employment Rights (Dispute Resolution) Act 1998. Section 10 is substituted, and section 10A inserted, by paragraph 3 of Schedule 8 to the Employment Relations Act 1999.
