ROAD TRAFFIC

The Road Vehicles (Authorised Weight) (Amendment) Regulations 2001

  Coming into force 17th April 2001 

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by section 41 of the Road Traffic Act 1988[1], and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Road Vehicles (Authorised Weight) (Amendment) Regulations 2001 and shall come into force on 17th April 2001.

Amendment of Road Vehicles (Authorised Weight) Regulations 1998
    
2.  - (1) The Road Vehicles (Authorised Weight) Regulations 1998[2] shall be further amended as follows.

    (2) In regulation 2, paragraph (1) shall be amended by - 

    (a) inserting in the appropriate alphabetical order the following definitions - 

      " "complies with" shall, in relation to the requirements of a Community Directive, be construed in accordance with regulation 6 of the 1986 Regulations[3];

      "diesel engine" shall be construed in accordance with paragraph 2.2 of Directive 88/77/EEC as amended by Directive 91/542/EEC, Annex 1;

      "Directive 88/77/EEC" means Council Directive 88/77 of 3 December 1987 on the approximation of the laws of the member states relating to the measures to be taken against the emission of gaseous and particulate pollutants from diesel engines for use in vehicles;

      "Directive 91/542/EEC" means Council Directive 91/542 of 1 October 1991 amending Directive 88/77/EEC;

      "first used" shall be construed in accordance with regulation 3(3) of the 1986 Regulations;

      "gas" has the meaning given in regulation 3(2) of the 1986 Regulations;

      "trailer" and "semi-trailer" have the meanings given in regulation 3(2) of the 1986 Regulations; and

      "wheel" has the meaning given in regulation 3(2) of the 1986 Regulations"; and

    (b) in the Table to the definition of "low pollution engine", substituting "(NOx)" for "(Nox)" in the heading to the third column.

    (3) In Schedule 2 - 

    (a) in paragraph 1(2), for the words "and 12" shall be substituted ", 12 and 14";

    (b) in paragraph 1(4), for the words "and 12" shall be substituted ", 12, 13 and 14";

    (c) after paragraph 1(4) shall be inserted the following sub-paragraph - 

        " (5) The condition referred to in items 13 and 14 of Table 3 is that the vehicle is fitted with a low pollution engine."; and

    (d) at the end, sub-paragraph (5) shall be omitted.

Amendment of the Road Vehicles (Authorised Weight) (Amendment) Regulations 2000
     3.  - (1) The Road Vehicles (Authorised Weight) (Amendment) Regulations 2000[4] shall be amended as follows.

    (2) In regulation 3, paragraph (2) shall cease to have effect.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations correct a number of errors that were made in the drafting of the Road Traffic (Authorised Weight) (Amendment) Regulations 2000 (S.I. 2000/3224), which amended the Road Traffic (Authorised Weight) Regulations 1998 (S.I. 1998/3111).

A copy of these Regulations will be made available free of charge to past and present purchasers of the Road Traffic (Authorised Weight) (Amendment) Regulations 2000.
