The Secretary of State, in exercise of the powers conferred by sections 1(1) and 3(1)(a) and (b) of the Wireless Telegraphy Act 1949[1] as enacted, and now vested in him[2], and of all other powers enabling him in that behalf, hereby makes the following Regulations - 1. These Regulations may be cited as the Wireless Telegraphy (Exemption) (Amendment) Regulations 2001 and shall come into force on 28th March 2001. 2. The Wireless Telegraphy (Exemption) Regulations 1999[3] are hereby amended as follows -
Public Mobile Operator Licences 1. Public mobile data systems licensed for use in the following frequency bands -

Meteor burst data systems licensed for use on the following frequencies -

Cellular radiotelephone systems licensed for use in the following services on the relevant frequency bands -
(b) digital cellular radiotelephones:
(c) digital cellular PCN radiotelephones:
(d) Universal Mobile Telephony System radiotelephones (UMTS):

Public access mobile radio systems licensed for use in the following frequency bands -

CDMA spread spectrum data asset tracking systems licensed for use in the following frequency bands -

Public two-way paging systems licensed for use in the following frequency bands -
Common Base Station Operator Licence
ETS 300 113 published by ETSI in July 1996.";
IR 2019 - UK Radio Interface Requirement for Third Generation Mobile Services published by RA in January 2001."; and
IR 2036 - UK Radio Interface Requirement for Mobile Asset Tracking Services published by RA in November 2000. Public two-way paging systems IR 2010 - UK Radio Interface Requirement for Public Paging Services published by RA in March 2000.";
(ii) the following definition shall be inserted after the definition of "prescribed apparatus" -
Land Mobile Earth Stations in the Thuraya Land Mobile-Satellite Service which are designed or adapted to -
(b) be capable of transmitting in the frequency bands 1625.5-1645.5 MHz and 1646.5-1660.5 MHz and receiving in the frequency bands 1525.0-1544.0 MHz or 1545.0-1559.0 MHz and operating at a power level not exceeding the maximum specified in the table set out in Part IV."; and
(f) the following table shall be inserted at the end of Part IV of Schedule 5 -
(This note is not part of the Regulations) These Regulations amend the Wireless Telegraphy (Exemption) Regulations 1999 (S.I. 1999/930, as amended by S.I. 2000/1012) in order to exempt additional wireless telegraphy equipment from the requirement to be licensed under section 1(1) of the Wireless Telegraphy Act 1949 (c. 54). Such equipment are stations established or used and apparatus installed or used in relation to the following systems or services:
(b) Universal Mobile Telephony System; (c) CDMA spread spectrum data asset tracking systems; (d) public two-way paging systems; and (e) Thuraya Land Mobile-Satellite Service.
