PREVENTION AND SUPPRESSION OF TERRORISM

NORTHERN IRELAND

The Terrorism Act 2000 (Code of Practice on the Exercise of Police Powers) (Northern Ireland) Order 2001

  Made 12th February 2001 
  Coming into force 19th February 2001 

Whereas:

    (1) pursuant to section 99(1)(a) of the Terrorism Act[1] ("the 2000 Act") the Secretary of State may issue a code of practice in connection with the exercise by police officers of any power conferred by the 2000 Act;

    (2) pursuant to section 101(2) of the 2000 Act, the Secretary of State has published a draft of the code of practice in connection with the exercise by police officers of the powers of detention and identification conferred by the 2000 Act and has considered representations made to him about it and modified it as he thinks appropriate;

    (3) pursuant to section 101(3) of the 2000 Act the Secretary of State has laid a draft of the code of practice before Parliament;

     Now, therefore, in exercise of the power conferred upon him by section 101(4) of the 2000 Act the Secretary of State hereby makes the following order, a draft of which has been laid before Parliament in accordance with section 123(4)(e) of the 2000 Act and approved by resolution of each House of Parliament:

Citation and commencement
     1. This order may be cited as the Terrorism Act 2000 (Code of Practice on the Exercise of Police Powers) (Northern Ireland) Order 2001 and shall come into force on 19th February 2001.

Code of Practice
    
2. The code of practice in connection with the exercise by police officers of the powers of detention and identification conferred by the 2000 Act which was laid before Parliament in draft on 15th January 2001 shall come into operation on 19th February 2001.

EXPLANATORY NOTE

(This note is not part of the Order)


This order appoints 19th February 2001 as the date upon which the code of practice on the exercise by police officers of the powers of detention and identification conferred by the Terrorism Act 2000 shall come into operation in Northern Ireland.
