The Secretary of State for the Environment, Transport and the Regions, after consulting the persons referred to in section 86(4) of the Merchant Shipping Act 1995[1], in exercise of the powers conferred by sections 85(1)(a), (3), (5) to (7) and 86(1) and (2) of that Act and of all other powers enabling him in that behalf, hereby makes the following Regulations: Citation and commencement 1. These Regulations may be cited as the Fishing Vessels (Code of Practice for the Safety of Small Fishing Vessels) Regulations 2001 and shall come into force on 1st April 2001. Interpretation 2. In these Regulations -
Application
(c) in the heading to Rule 105 and in paragraph (1) of that Rule, for "9 metres" there shall be substituted "12 metres".
Amendment of the Fishing Vessels (Life-Saving Appliances) Regulations 1988
Prohibition on proceeding on any voyage unless Code of Practice complied with
(b) by a body or laboratory of an EEA State other than the United Kingdom offering suitable and satisfactory guarantees of technical and professional competence and independence.
Penalties (This note is not part of the Regulations) These Regulations provide for fishing vessels of less than 12 metres in length to comply with the requirements of the "Code of Practice for the Safety of Small Fishing Vessels" published by the MCA. They also provide for the amendment of the Fishing Vessels (Safety Provisions) Rules 1975 and the Fishing Vessels (Life-Saving Appliances) Regulations 1988 so that those instruments no longer apply to fishing vessels of less than 12 metres in length (regulations 4-6). The Regulations provide that if a vessel proceeds or attempts to proceed on any voyage without complying with the Code of Practice, that is an offence on the part of the owner and the skipper (regulation 8), and the vessel is liable to be detained (regulation 9). A Regulatory Impact Assessment has been produced and a copy placed in the library of both Houses of Parliament.
