In exercise of the powers conferred on the Secretary of State by sections 484 and 569(4) of the Education Act 1996[1] the Secretary of State for Education and Employment hereby makes the following Regulations:
1. These Regulations may be cited as the Education Standards Fund (England) (Amendment No. 2) Regulations 2000 and shall come into force on 12th January 2001.
2. The Education Standards Fund (England) Regulations 2000[2] shall be amended as follows.
3. In regulation 2(1) the following definition shall be inserted at the appropriate place -

"maintained nursery school" means an institution, other than a primary school, which provides full-time or part-time education suitable for children who have not attained compulsory school age and which is maintained by an education authority;".

In regulation 5(2) the following entries shall be inserted at the end of the table in the left hand and right hand columns respectively -

Schedule 1 shall be amended by inserting after paragraph 53 the following paragraphs -

54.
Support for measures to develop and extend the services provided by maintained nursery schools.
55. Support for schemes by education authorities to pilot new methods of providing education services."

These Regulations further amend the Education Standards Fund (England) Regulations 2000. They add 2 new purposes for or in connection with which grant is payable. The new purposes relate to developing and extending the services offered by maintained nursery schools and schemes by LEAs to pilot new methods of providing education services. They also make consequential amendments to regulations 2(1) and 5(2).
