The Secretary of State, in exercise of his powers under section 125(3) of the Environment Act 1995[1], hereby makes the following Order: Citation 1. This Order may be cited as the Environment Act 1995 (Commencement No. 18) (England and Wales) Order 2000. Provision coming into force on 1st December 2000 2. Section 116 of the Environment Act 1995 shall come into force on 1st December 2000 in so far as it relates to paragraph 1(1) of Schedule 21[2]. Signed by authority of the Secretary of State Michael Meacher Minister of State, Department of the Environment, Transport and the Regions 9th November 2000 (This note is not part of the Order) Article 2 brings into force on 1st December 2000 paragraph 1(1) of Schedule 21 to the Environment Act 1995, which substitutes a new section 221 of the Water Industry Act 1991 (Crown application). (This note is not part of the Order) The following provisions of the Environment Act 1995 have been brought into force by commencement orders made before the date of this Order.

Though some functions of the Secretary of State under the 1995 Act in relation to Wales were transferred by article 2 of and Schedule 1 to the National Assembly of Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), the functions of the Secretary of State under section 125 of the 1995 Act are retained in relation to Wales, see article 2(e) of S.I. 1999/672.back [2] This paragraph substitutes section 221 of the Water Industry Act 1991 (c. 56). Section 221 of that Act extends to England and Wales only (see section 222(3) of that Act), and accordingly so does paragraph 1(1) of Schedule 21 to the Environment Act 1995 (see section 125(10) of that Act).back
