EDUCATION, ENGLAND AND WALES

The Education (School Teachers' Pay and Conditions) (No. 3) Order 2000

  Made 25th August 2000 
  Laid before Parliament 30th August 2000 
  Coming into force 1st September 2000 

Whereas the review body appointed under section 1(1) of the School Teachers' Pay and Conditions Act 1991[1] ("the Act") have made a report following the reference to them of certain matters;

     And whereas the Secretary of State has consulted, in accordance with section 2(1) of the Act[2], such associations of local education authorities, such bodies representing the interests of governors of foundation, voluntary, and foundation special schools and such bodies representing school teachers as appeared to him to be concerned;

     Now, therefore, the Secretary of State, in exercise of the powers conferred by sections 2(1), (3) and (4) and 5(4) of the Act[3] hereby makes the following Order:

Citation, commencement and revocation
     1.  - (1) This Order may be cited as the Education (School Teachers' Pay and Conditions) (No. 3) Order 2000 and shall come into force on 1st September 2000.

    (2) The Education (School Teachers' Pay and Conditions) (No. 2) Order 1999[
4] and the Education (School Teachers' Pay and Conditions) Order 2000[5] are hereby revoked.

Application
     2. This Order applies to school teachers (as defined in section 5(1) and (2) of the Act[6]) in England and Wales.

School Teachers' Pay and Conditions
     3. It is hereby directed that the provisions set out in the document published by Her Majesty's Stationery Office and entitled "School Teachers' Pay and Conditions Document 2000"[7] ("the Document") shall have effect from 1st September 2000 with the modifications set out in article 4.

     4. The Document is amended as follows:

    (a) in paragraph 1.2 - 

    (b) paragraphs 3.1(c), and 3.5 are omitted;

    (c) in paragraph 3.3(b) "under paragraph 19 or" are omitted;

    (d) in paragraph 11.3.2 the following is substituted for sub-paragraph (a) - 

      " (a) £25,959;";

    (e) paragraph 17.1 is omitted;

    (f) paragraph 18.3 is omitted;

    (g) in paragraph 18.4 - 

      (i) "and paragraph 18.3.2" are omitted, and

      (ii) "18.1 and 18.2" are substituted for "18.1, 18.2 and 18.3";

    (h) paragraph 19 is omitted;

    (i) in paragraphs 26(a) and 27.1(a) the words from ", or in the case" to the end of each sub-paragraph are omitted;

    (j) in paragraph 29.3.2, the words from ", unless" to the end of the paragraph are omitted;

    (k) in paragraph 30.2 "subject to paragraphs 30.3 and 30.5," are omitted;

    (l) paragraphs 30.3 and 30.5 are omitted;

    (m) for paragraph 30.4 there is substituted - 

      " 30.4 A classroom teacher who was last employed as a head teacher, deputy head teacher or assistant head teacher shall not be paid at less than point 9 on the pay scale set out in paragraph 17.3.";

    (n) in paragraph 30.6 - 

      (i) in sub-paragraph (a) "paragraph 30.2" is substituted for "paragraphs 30.2 to 30.4", and

      (ii) in sub-paragraph (b) "paragraph 30.4" is substituted for "paragraphs 30.3 and 30.4";

    (o) in paragraph 37.5(d) - 

      (i) "18.1 or 18.2" are substituted for "18.1, 18.2 or 18.3", and

      (ii) "or an increase in salary caused by the teacher having become entitled to be paid as a post-threshold teacher" are omitted;

    (p) in paragraph 40.4 - 

      (i) in paragraph (a) the words from "who is not" to "arises" are omitted, and

      (ii) paragraph (b) is omitted;

    (q) in paragraph 40.12(d)(i) "19," is omitted;

    (r) paragraph 51.8.6 is omitted; and

    (s) in paragraph 58.11.1, the words from "and assisting" to the end of the paragraph are omitted.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order, which is made under section 2(1) of the School Teachers' Pay and Conditions Act 1991 ("the Act"), refers to a document entitled " School Teachers' Pay and Conditions Document 2000" ("the Document") published by Her Majesty's Stationery Office, which is obtainable from Government book shops and through booksellers.

The Order directs that the provisions set out in the Document shall have effect from 1st September 2000 with the modifications listed in article 4. The Document is amended to delete paragraph 19 (pay scale for post-threshold teachers), the professional duties in relation to performance threshold assessments and paragraph 18.3 (pay point for fast-track teachers). The Order also makes consequential amendments to the Document.

The Order applies to all school teachers (as defined in section 5(1) and (2) of the Act) in England and Wales. By virtue of section 2(6)(a) of the Act, the remuneration of school teachers to whom the Order applies is to be determined and paid to them by local education authorities in accordance with the pay scales and other provisions of the Document. By virtue of section 2(6)(b) of the Act, the provisions set out in the Document relating to the statutory conditions of employment have effect as terms of the contracts of employment of school teachers to whom the Order applies.
