ROAD TRAFFIC

The Motor Vehicles (Approval) (Amendment) Regulations 2000

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred by sections 54, 61, 63 and 66 of the Road Traffic Act 1988[1], and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby make the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Motor Vehicles (Approval) (Amendment) Regulations 2000 and shall come into force on 18th August 2000.

Amendment of the Motor Vehicles (Approval) Regulations 1996
    
2. The Motor Vehicles (Approval) Regulations 1996[2] are amended as follows.

     3. In paragraph (1) of regulation 3, sub-paragraph (b) shall be omitted.

    
4. In paragraph (1) of regulation 5, the word "and" shall be inserted after sub-paragraph (a) and the words from "and" after sub-paragraph (b) to the end of sub-paragraph (c) shall be omitted.

    
5. In paragraph (2) of regulation 12, for sub-paragraph (a) shall be substituted - 

      " (a) the letter "R" if the certificate is being issued otherwise than on a basis specified in sub-paragraphs (aa) to (d) below".

     6. In Schedule 1, paragraph 1 shall be omitted.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations further amend the Motor Vehicles (Approval) Regulations 1996.

Regulations 3 and 4 concern the application of the 1996 Regulations. They remove the requirement (in regulations 3 and 5) that passenger vehicles, other than motor ambulances and motor caravans, and goods vehicles must fall within one of the categories specified in Schedule 1.

Schedule 1 will continue to apply for the purposes of regulation 12(2) which concerns the Type Code to be inserted in the Minister's approval certificate. For those purposes, regulation 6 removes the category specified in paragraph 1 of Schedule 1 (vehicles entering into service in very low numbers) and regulation 5 provides for certificates to bear the Type Code "R" in the case of vehicles not falling into any of the remaining Schedule 1 categories.
