The United Nations (Sanctions) (Amendment) Order 2000

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by section 1 of the United Nations Act 1946[1], is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

     1.  - (1) This Order may be cited as the United Nations (Sanctions) (Amendment) Order 2000 and shall come into force on 11th May 2000.

    (2) This Order shall, to the extent that it makes provision in relation to any Order of Her Majesty in Council in force in each of the Channel Islands, in the Isle of Man or in any territory specified in Schedule 1 to this Order, have effect as part of the law of that one of the Channel Islands, or as part of the law of the Isle of Man or of that territory.

    
2. The Orders listed in Schedule 2 are amended by inserting:

    (a) after the word "licence" wherever it appears, and after the word "permission" wherever it appears, the words "in writing"; and

    (b) before the words "or a British protected person" wherever they appear, the words ", a British National (Overseas)" except where those words already appear in the relevant sub-paragraph.

     3. The Orders listed in Schedule 3 are amended as specified in that Schedule.

The Afghanistan (United Nations Sanctions) Order 1999. S.I. 1999/3133. Article 1(3) shall be amended to read "This Order shall extend to the United Kingdom, and, except in relation to articles 4 and 5, to the Channel Islands and the Isle of Man.".In article 8(1) the words "article 3(2)" shall be replaced by "article 3(3)".In paragraph 2(b) of the Schedule to the Order after "United Kingdom" there shall be inserted "or under or in the service of the States of Guernsey or Alderney or the Chief Pleas of Sark or as the case may be, the States of Jersey or under or in the service of the Government of the Isle of Man."
The Afghanistan (United Nations Sanctions) (Overseas Territories) Order 1999. S.I 1999/3136. In article 8(1) the words "article 3(2)" shall be replaced by "article 3(3)".
The Angola (United Nations Sanctions) Order 1998. S.I. 1998/1752. In article 18(4) the words "article 10(2)" shall be replaced by "article 11(2)".



EXPLANATORY NOTE

(This note is not part of the Order)


This Order, made under the United Nations Act 1946, amends the Orders listed in Schedule 2 to clarify that licences and permissions issued under Orders under the Act shall be in writing and to reflect the creation of British National (Overseas) status. It also makes textual amendments to the Orders listed in Schedule 3.

Of the Orders listed in Schedule 2:

    (a) pursuant to a decision of the UN Security Council in its resolution 1192 of 27th August 1998 in relation to Libya, and following the issue on 5th April 1999 of a report by the Secretary-General of the United Nations, the operation of S.Is. 1992/973 and 1992/974 was suspended; and the operation of S.Is. 1993/2807, 2808, 2811 and 2812 was suspended, except in relation to the implementation of article 13 of each of those Orders;

    (b) pursuant to a UN Security Council decision in resolution 1074 of 1st October 1996 in relation to the former Yugoslavia, S.Is. 1992/1302, 1303 and 1308 ceased to have effect except in relation to the implementation of article 9 of each of those Orders;

    (c) pursuant to a UN Security Council decision in resolution 944 of 29th September 1994 in relation to Haiti, S.Is. 1994/1323, 1324, 1325 and 1326 ceased to have effect except in relation to the implementation of article 10 of each of those Orders.
