FOOD, ENGLAND AND WALES

The Contaminants in Food (Amendment) (England and Wales) Regulations 1999

  Coming into force 30th December 1999 

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health and the Secretary of State for Wales, acting jointly, in relation to England and Wales, in exercise of the powers conferred on them by section 17(2) of the Food Safety Act 1990[1] and of all other powers enabling them in that behalf, hereby make the following Regulations:

Title, commencement and extent
     1. These Regulations may be cited as the Contaminants in Food (Amendment) (England and Wales) Regulations 1999, shall come into force on 30th December 1999 and shall apply to England and Wales.

Amendment of the Contaminants in Food Regulations 1997
    
2. In regulation 2(1) (interpretation) of the Contaminants in Food Regulations 1997[2], for the definition of "the Commission Regulation" there shall be substituted the following definition:

           " "the Commission Regulation" means Commission Regulation (EC) No. 194/97 setting maximum levels for certain contaminants in foodstuffs[3], as amended by Commission Regulation (EC) No. 1525/98[4], Commission Regulation (EC) No. 864/1999[5] and Commission Regulation (EC) No. 1566/1999[6];".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations, which apply to England and Wales, amend the Contaminants in Food Regulations 1997 by bringing up to date a reference to Commission Regulation (EC) No. 194/97 (as amended) setting maximum levels for certain contaminants in foodstuffs, so as to cover its further amendment by Commission Regulation (EC) No. 1566/1999 which altered the date by which the maximum aflatoxin limits laid down for nuts and dried fruit have to be reconsidered by the Standing Committee on Foodstuffs from 1st July 1999 to 1st July 2001 and similarly altered the date from which specified maximum limits will apply to cereals.
