The Secretary of State for Health, in exercise of powers conferred on him by section 126(4) of, and paragraph 2(d) of Schedule 7 to, the National Health Service Act 1977[1], and of all other powers enabling him in that behalf, hereby makes the following Regulations: Citation, commencement and interpretation 1. - (1) These Regulations may be cited as the Community Health Councils (Amendment) Regulations 1999 and shall come into force on 16th November 1999. (2) In these Regulations -
Amendment of regulation 18 (This note is not part of the Regulations) These Regulations amend the Community Health Councils Regulations 1996 to provide that the duty on Health Authorities to consult a Community Health Council on proposals for substantial developments or variations in the health service in the Council's district (regulation 18(1) of the 1996 Regulations) does not apply to proposals to establish or dissolve a Primary Care Trust in England. Section 126(4) is amended by paragraph 37(6) of Schedule 4 to the Health Act 1999 (c. 8); paragraph 2(d) of Schedule 7 was inserted by paragraph 15 of Schedule 3 to the Health and Social Security Act 1984 (c. 48) and was amended by paragraph 62(a) of Schedule 1 to the Health Authorities Act 1995 (c. 17). See section 128(1), as amended by section 26(2)(g) and (i) of the 1990 Act, for the definitions of "prescribed" and "regulations". The functions of the Secretary of State under these provisions of the 1977 Act are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672.back
