The Secretary of State for Health, in exercise of the powers conferred on him by section 126(3) of the National Health Service Act 1977[1] and section 5(1) of the National Health Service and Community Care Act 1990[2] and of all other powers enabling him in that behalf, after completion of the consultation prescribed under section 5(2) of the latter Act[3], hereby makes the following Order: Citation and commencement and interpretation 1. - (1) This Order may be cited as the Doncaster Healthcare National Health Service Trust Change of Name and (Establishment) Amendment Order 1999 and shall come into force on 1st October 1999. (2) In this Order -
Change of name of NHS trust
3. - (1) The trust is established for the purposes specified in section 5(1) of the Act. (2) The trust's functions shall be -
(b) to provide goods and community health services within the area of Doncaster Metropolitan Borough Council and North Lincolnshire Council for the purpose of the health service."
Transitional provisions
(b) be taken as invalidating any instrument (whether made before, on or after the day on which this Order comes into force) which refers to the trust by its previous name;
and all instruments and other documents which refer to the trust under its previous name shall be construed as if referring to it under its new name. (This note is not part of the Order) This Order changes the name of a National Health Service trust established by the Doncaster Healthcare National Health Service Establishment Order ("the Establishment Order") under Part I of the National Health Service and Community Care Act 1990 from the Doncaster Healthcare National Health Service Trust to the Doncaster and South Humber Healthcare National Health Service Trust (article 2) and includes transitional provisions (article 4). This Order also amends the Establishment Order to confer on the trust the purposes specified in section 5(1) of the National Health Service and Community Care Act 1990 to provide goods and services for the purposes of the health service, namely (i) mental health services and specialist health services to people with a learning disability within the areas of Doncaster Metropolitan Borough Council, North Lincolnshire Council, North East Lincolnshire Council and (ii) community health services within the area of Doncaster Metropolitan Borough Council and North Lincolnshire Council.
