The Education (School Inspection) (England) (Amendment) (No. 2) Regulations 1999

In exercise of the powers conferred on the Secretary of State by section 45(3) of, paragraph 6 of Schedule 3 to, and paragraph 2(2) of Schedule 4 to the School Inspections Act 1996[1] and section 144 of the School Standards and Framework Act 1998[2], the Secretary of State for Education and Employment hereby makes the following Regulations:

Citation, commencement and interpretation
     1.  - (1) These Regulations may be cited as the Education (School Inspection) (England) (Amendment) (No. 2) Regulations 1999 and shall come into force on 1st October 1999.

    (2) In these Regulations "the 1997 Regulations" means the Education (School Inspection) (England) Regulations 1997[
3].

Amendment of 1997 Regulations
     2. The 1997 Regulations shall be amended as follows:

    (1) In regulation 5 - 

    (a) in both paragraphs (1)(a) and (1)(b) for the words "county, voluntary or maintained special school" substitute the words "school maintained by a local education authority";

    (b) omit paragraph (1)(c);

    (c) in paragraph (1)(d) omit the words "or a grant-maintained school which, immediately before it became a grant-maintained school, was a voluntary school" and for the words "an aided or special agreement" substitute the words "voluntary aided";

    (d) omit paragraph (1)(e);

    (e) omit paragraph (1)(f);

    (f) after paragraph (2)(a) insert the word "and" and omit paragraphs (2)(c) and (d).

    (2) In regulation 6(c) for the words "three weeks" substitute the words "one week".

    (3) In regulation 12(1), for the words from "grant-maintained" to "(or both)" substitute the words "foundation school are required by section 23 of the 1996 Act to secure that denominational education given to any pupils and the content of the school's collective worship".

    (4) In regulation 13 - 

    (a) in paragraph (2) for the words "five weeks" substitute the words "six weeks";

    (b) omit paragraphs (4)(c) and (d).

EXPLANATORY NOTE

(This note is not part of the Regulations)


The School Standards and Framework Act 1998 ("the 1998 Act") provides for new categories of maintained schools which will replace, from 1st September 1999, the existing categories of such schools. The 1998 Act amends the Education Act 1996 and the School Inspections Act 1996 by substituting references to those new categories and a new definition of the term "maintained school". These regulations amend the Education (School Inspection) (England) Regulations 1997 to reflect those changes made by the 1998 Act.

These Regulations also alter the period of notice that must be given to parents of a parents meeting, and alter the period of time in which a report of an inspection of religious education and collective worship must be prepared.
