The Secretary of State, in exercise of the powers conferred on him by section 38 of the Employment Relations Act 1999[1]hereby makes the following Regulations - Citation, commencement, interpretation and extent 1. - (1) These Regulations may be cited as the Transfer of Undertakings (Protection of Employment) (Rent Officer Service) Regulations 1999 and shall come into force on 30th September 1999. (2) In these Regulations "the 1981 Regulations" means the Transfer of Undertakings (Protection of Employment) Regulations 1981[2]. Application of the 1981 Regulations 2. These Regulations apply where, by virtue of the Administration of the Rent Officer Service (England) Order 1999[3], a scheme made under section 63 of the Rent Act 1977[4] which requires a local authority to provide rent officers with clerical and other assistance is revoked and the Secretary of State becomes subject to a similar obligation. 3. Where these Regulations apply any person employed for the purposes of providing clerical and other assistance as mentioned in regulation 2 shall be treated in the same way as an employee in circumstances where the 1981 Regulations apply. 4. For the purposes of these Regulations, the employing local authority shall be treated as transferor and the Secretary of State shall be treated as the transferee. Alan Johnson, Parliamentary Under Secretary of State for Competitiveness, Department of Trade and Industry 9th September 1999 (This note is not part of the Regulations) These Regulations provide that the same protections as those afforded by the Transfer of Undertakings (Protection of Employment) Regulations 1981 to employees in circumstances to which those Regulations apply shall apply to employees who provide clerical and other assistance to rent officers pursuant to section 63 of the Rent Act 1977 when, pursuant to the Administration of the Rent Officer Service (England) Order 1999, local authorities cease to be required to provide such clerical and other assistance and the Secretary of State becomes subject to a similar obligation.
