EUROPEAN PARLIAMENT

The European Parliamentary (United Kingdom Representatives) Pensions (Additional Voluntary Contributions Scheme) (Amendment) Order 1999

  Laid before Parliament 27th July 1999 
  Coming into force 17th August 1999 

The President of the Council, in exercise of the powers conferred by section 4(1), (2) and (3) of the European Parliament (Pay and Pensions) Act 1979[1] and now vested in her[2] hereby makes the following Order:-

Title and commencement
     1. This Order may be cited as the European Parliamentary (United Kingdom Representatives) Pensions (Additional Voluntary Contributions Scheme) (Amendment) Order 1999 and shall come into force on 17th August 1999.

Interpretation
    
2. In this Order-

and other expressions shall have the same meaning as in the AVC Order.

Contributors
     3. In article 2(1) of the AVC Order-

4. For article 5(3)(a) of the AVC Order, there shall be substituted-

Maximum pensions
    
5. In paragraph 3(2)(a) of Schedule 2 to the AVC Order, for the words " that the number (not exceeding 40) of years of service completed before leaving service bears to the potential number (not exceeding 40) of years of service had the contributor remained in service to normal retirement date", there shall be substituted "on the basis that service is taken as the potential number of years of service had the contributor remained in service to the normal retirement date".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the European Parliamentary (United Kingdom Representatives) Pensions (Additional Voluntary Contributions Scheme) (No. 2) Order 1995.

Article 3 amends the definitions of "Class A contributor" and " Class C contributor". The amendments permit any person who became a member of the European Parliamentary pension scheme before 1st June 1989, by giving notice in writing to the Managers of the scheme, to elect to be treated as if he had become a member of the scheme on or after that date.

Article 4 relaxes the limits on contributions to the AVC scheme, but still within overall Inland Revenue constraints.

Article 5 amends a paragraph of Schedule 2 of the 1995 Order to correct a typographical error.
