Whereas the Council for Professions Supplementary to Medicine has, in accordance with the provisions of section 10(1) of the Professions Supplementary to Medicine Act 1960[1], recommended to the Privy Council that the Act should extend to the profession of clinical scientists:
And whereas a draft of this Order has been laid before Parliament and approved by resolution of each House:
Now, therefore, Their Lordships, in exercise of the powers conferred on Them by section 10(2) of the Act, and all other powers enabling Them in that behalf, after consulting, as boards appearing to Them to be concerned, all the boards established under the Act and existing on the day before that on which this Order was made, are pleased to order, and it is hereby ordered, as follows-
Citation, commencement and interpretation
1. - (1) This Order may be cited as the Professions Supplementary to Medicine (Clinical Scientists Board) Order of Council 1999 and shall come into force immediately after the coming into force of the Professions Supplementary to Medicine (Speech and Language Therapists Board) Order of Council.
(2) In this Order, "the Act" means the Professions Supplementary to Medicine Act 1960.
Extension of application of the Act to the profession of clinical scientists
2. The Act shall have effect as if the profession of clinical scientists were mentioned in section 1(2) of the Act, and accordingly the First Schedule to the Act (constitutions of the Council and boards, and supplementary provisions) shall have effect as if there were made the further alterations, additions or omissions specified in the Schedule to this Order.

1. Part I of the First Schedule to the Act (constitutions of the Council and boards, and Supplementary Provisions) shall have effect as if-
-
(a) in paragraph 1(1), for "thirty" there were substituted "thirty-three";
(b) in paragraph 1(1)(b), for "nine" there were substituted "eleven" and for "four only shall be registered medical practitioners" there were substituted "five only shall be registered medical practitioners";
(c) in paragraph 1(1)(c), for "ten" there were substituted "eleven";
(d) in paragraph 3(2), for "the professions of arts therapists, orthoptists, prosthetists and orthotists and speech and language therapists" there were substituted "the professions of arts therapists, clinical scientists, orthoptists, prosthetists and orthotists, and speech and language therapists"; and
(e) after paragraph 3(6) there were added the following sub-paragraph-

(7) Before making an appointment under this paragraph as respects the profession of clinical scientists the said Ministers shall consult the Registration Council of Scientists in Health Care.".

Part II of the First Schedule to the Act (Constitution of the boards) shall have effect as if-
-
(a) in the table at the end of paragraph 4(1)-

(i) in column (4) there were added after sub-column (g), sub-columns (h) and (i) with the headings respectively "The Royal College of Pathologists" and "The Royal College of Radiologists", with the symbol "-" in both sub-columns in the entries for each existing board, and
(ii) under the line relating to membership of the Chiropodists Board, there were inserted the entries set out below in relation to the Clinical Scientists Board-

(b) after paragraph 7(4C) there were inserted the following sub-paragraph-

(4D) Of the two members of the Clinical Scientists Board appointed in pursuance of the said paragraph (d)-
-
(a) one shall be a member of a body which represents the interests of employers of clinical scientists;
(b) one shall be a member of a body which represents the interests of patients of clinical scientists or of carers of such patients (or of both)."; and
(c) in paragraph 8(3), for "(2), (3), (4), (5) or (6)" there were substituted "(2), (3), (4), (5), (6) or (7)".
(This note is not part of the Order)
This Order extends the Professions Supplementary to Medicine Act 1960 to the profession of clinical Scientists. The Order has the effect, in consequence of that extension, of establishing the Clinical Scientists Board. It makes amendments to that Act in relation to the composition of the Council for Professions Supplementary to Medicine and makes specific provision in respect of the composition of the Clinical Scientists Board.

The Act was extended to the profession of orthoptists by S.I. 1966/990, to the profession of prosthetists and orthotists by S.I. 1997/504, to the profession of arts therapists by S.I. 1997/1121, and to the profession of speech and language therapists by S.I. 1999/1855; and ceased to extend to the profession of remedial gymnasts by virtue of S.I. 1986/630. The First Schedule to the Act has effect as if amended by all five instruments.back
