In exercise of the powers conferred on the Secretary of State by sections 23(7) and 45(3) of, and paragraph 6 of Schedule 3 and paragraph 3(2) of Schedule 4 to, the School Inspections Act 1996[1] and section 569(4) and (5) of, and paragraph 3 of Schedule 1 to, the Education Act 1996[2], the Secretary of State for Wales hereby makes the following Regulations: Citation, commencement and interpretation 1. - (1) These Regulations may be cited as the Education (School Inspection) (Wales) (Amendment) Regulations 1999 and shall come into force on 1st September 1999. (2) In these Regulations "the principal Regulations" means the Education (School Inspection) (Wales) Regulations 1998[3]. Amendment of Principal Regulations 2. The principal Regulations shall be amended as follows. 3. In regulation 5-
(b) omit paragraph (1)(c); (c) for paragraph (1)(d) substitute-
(d) omit paragraph (1)(e);
(g) in paragraph (2)(b) for "section 311 of the Education Act 1996" substitute "section 142(1) of the School Standards and Framework Act 1998", and omit paragraphs (2)(c) and (2)(d).

In regulation 6(d)(v) for "section 3(2)" substitute "section 6(2)". (This note is not part of the Regulations) The School Standards and Framework Act 1998 ("the 1998 Act") provides for new categories of maintained schools which will replace, from 1st September 1999, the existing categories of such schools. The 1998 Act amends the Education Act 1996 and the School Inspections Act 1996 by substituting references to those new categories and a new definition of the term "maintained school". These regulations amend the Education (School Inspection) (Wales) Regulations 1998 to reflect those and other changes made by the 1998 Act.
