The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred upon him by sections 2(9) and 15(5) of the Local Government Act 1988[1] hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Tower Hamlets London Borough Council) Order 1999 and shall come into force on 17th June 1999. Exemption of maintenance of ground 2. The maintenance of ground[2] by Tower Hamlets London Borough Council shall not be treated as a defined activity so long as-
(ii) the planting and tending of trees, hedges, shrubs, flowers and other plants in ornamental and formal gardens, and the controlling of weeds in such gardens, (iii) the tending of formal hedges, and (iv) the planting and tending of trees, hedges, shrubs, flowers and other plants on land from which shrubs, flowers and other plants are removed seasonally, and the controlling of weeds on such land;
(b) it is not carried out at Victoria Park; and
(This note is not part of the Order) Under Part I (competition) of the Local Government Act 1988 work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled. Article 2 of this Order exempts from the requirements of Part I ground maintenance by Tower Hamlets London Borough Council from 17th June 1999 to, and including, 30th June 2000. The exemption applies to land in the Borough other than Victoria Park and is limited to the tasks specified in article 2(1)(a).
